Galderma Australia Pty Ltd – Benzac Clear Skin for Summer Promotion

Terms of entry

1. Information on how to enter and the prizes form part of these Terms of entry (Terms). Participation in the promotion conducted pursuant to these Terms is deemed acceptance of these Terms. Should there be any conflict between the Terms and the promotion details the Terms will prevail.
2. The promotion will be conducted on www.benzac.com.au/win, https://www.chemistwarehouse.com.au/shop-online/988/benzac, https://www.facebook.com/Benzac.ANZ, and Instagram 
3. Entry is open to all Australian permanent residents aged 14 years and over.
4. Officers, employees and contractors (and their immediate families) of the Promoter or the agencies or companies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister, natural or adopted child or step-child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee, officer or contractor.
5. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a user if Promoter becomes aware that the user and/or the user's entry is of a type described in this clause.
6. The Promoter reserves the right to verify and determine, in its sole discretion, the validity of entries and entrants (including an entrant's identity and address).  The Promoter may, in its sole discretion, disqualify any entrant who submits an entry that is not in accordance with these Terms or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. One entry per person is permitted.
8. Competition opens on 27th September at 9am AEST. Promotion closes 27th October 2019 at 9am AEST.
9. To enter, entrants must, during the Promotional Period, enter by: Submitting a creative entry and telling Galderma Australia Pty Ltd in 25 words or less:

10. Personal information disclosed is provided to Galderma Australia Pty Ltd and not to Facebook.
11. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a user (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
12. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers, to assist in conducting the promotion. Entry is conditional on providing this information.
13. If entrants indicate their consent on the entry form, each entrant agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
14. Incomplete or indecipherable entries will be deemed invalid.
15. Winners: The most creative or engaging entry during the promotional period, as determined by the judges in their sole discretion, will be declared the winner. If for any reason the preferred prize is no longer available, an alternative prize will be provided. Prizes will not be redeemable for cash.
16. If for any reason the winner is unable to accept the Prize, the winner will forfeit the Prize and no compensation will be given in lieu.
17. The Promoter will not be liable for any prizes that do not reach a winner for any reason beyond the Promoter's reasonable control.
18. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.
19. Prizes are not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation.
20. Subject to any written directions from a regulatory authority, in the event of a prize not being accepted or claimed within 3 days of notification of the winners, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to conduct a further draw. Any winner will be notified by email and will be published on the Facebook page.
21. The draw will be conducted by the Promoter, at Suite 4, 13B Narabang Way, Belrose, NSW 2085 on 28th October 2019 at 11am AEST.
22. The winners will be notified via email, https://www.facebook.com/Benzac.ANZ and Instagram on the day of the draw.
23. Prize Pool: Twenty-five (25) x $500 Visa Card Vouchers, total prize pool valued at RRP AU$12,500.The Prize value details are correct at the time of commencement of the Promotional Period.
24. Multiple vouchers cannot be won by an entrant, with a total of 25 entrants to be drawn at the conclusion of the promotional period.
25. The Promoter’s decision is final and no correspondence will be entered into.
26. Nothing in these Terms limits, excludes or modifies or purports to limit, the statutory consumer guarantees as provided under the Competition and Consumer Act, and any other implied warranties under the Australian Consumer Law or similar consumer protection laws in the State and Territories of Australia that cannot be excluded (Non Excludable Condition), Except for liability in relation to a Non Excludable Condition.
27. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
28. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
29. Any cost associated with accessing the promotional website and/or email address is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
30. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a user or entrant; (f) the acceptance or use of a prize; (g) any act or omission of the Promoter or its associated agencies.
31. As a condition of accepting the prize, the users (and any companion/s) may be asked to sign any legal documentation as and in the form required by the Promoter /Prize Supplier/organisers in their absolute discretion including but not limited to a legal release and indemnity form.
32. The Promoter is Galderma Australia Pty Ltd ABN 12 003 976 930 of Suite 4, 13B Narabang Way, Belrose, 2085 New South Wales.
33. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
34. Winners will be notified by email. Winners must contact the promotor within seven (7) business days.
